Commencement of the Assisted Decision Making (Capacity) Act 2015

The Assisted Decision Making (Capacity) Act 2015 commenced on the 26th of April. The Decision Support Service (DSS) an independent statutory service, with functions to promote, register and supervise the new decision support arrangements. The DSS has issued 13 codes of practice, these codes include a general code on supporting decision-making and assessing capacity
and a specific code for financial services providers.
These codes are available on the DSS website or are available in the compliance section of the members website in the newly created folder “Assisted Decision Making (Capacity) Act 2015/Legislation & Codes”. To reflect the commencement of the act, Brokers Ireland has drafted an outline of the requirements of the Act and the Consumer Protection Code and has developed a template to be used when dealing with consumers who may require additional assistance.
